As much as I love a freeper emotional meltdown, Scalia actually does cover some salient points in his dissent.
ReplyDeleteBoth the DOMA and Prop 8 decisions (in which Scalia joined the majority) really are not the "watershed" gay-marriage decisions that both sides claim them to be.
Freepers, however, do not care about reading the actual decisions ...
they love to play the boo-hoo victims in all cases.
Really, if the future of conservatism depends on the infantile mewlings of freepers such as these, God help them.
All the decisions do is let the states on gay marriage. But for some reason, the same freepers who are supposedly all for states' rights have a problem with this.

DeleteThe jurisdictional bit has me a bit worried - I don't like the idea that 2 of the three branches of government can work together to ignore the third, I'd prefer more of a consensus, especially when that third branch is the more deliberate judiciary.
The substantive part is unfair. Scalia insisting on doctrinal clarity from Kennedy? Yeah, that's more tilting at windmills than anything else.
For better or worse (and I do think worse) the opinion was particularly Kennedy-ish, and thus a particularly good target for Scalia. Which is what made it so glorious.
