Washington Redskins trademark revoked

The USPTO, independently of the Administration, has revoked the Washington Redskins' trademarks due to their name being “disparaging to Native Americans.”

It's a big brouhaha over a small issue. Hell, even without their trademark, the Redskins' logo and font are copyrighted, so this may be more symbolic than financial. But Freepers do their best to make a mountain out of this molehill:

Hmmm. The Patent Office approved the patent application quite a while ago, I would guess. As far as I know, they can't legally change their decision after rendering it, and having the applicant invest money in building the brand. The bureaucrats can't un-throw that rock. If the name has genuinely become disparaging, the marketplace will take care of it, people will avoid watching the REDSKINS play, and it will fall into disuse.

This is one of the few cases where the Supreme Court has jurisdiction, since the case it Federal, and it should go there.

What's embarrassing is the amateurish quality of the Democratic revolutionaries.
Attention Surplus Disorder thinks the takings clause applies to trademarks:
I would think that the Redskins could take a casualty tax deduction in the mid-single-digit billions of dollars for this “taking”. It is unprecedented.

Two hundred years ago there was a move to make the Indian disappear. He was moved to Indian Territory(Oklahoma), his mounds and villages torn down, burial grounds looted. Anything significant was considered made by the mythical Welsh Prince MODOC.

In the 1970s Indians began to make a comeback with silly Mazola commercials, Movies, and statements by actors like Marlon Brando, along with civic disorder like at Wounded Knee in 1973.

Now the American Indian is again disappearing, pushed out of the Sports realm by over zealous Leftists who fear the memory of the Indian may be offensive to Indians when they really are offensive to the Leftists.

  1. I'm sorry I missed the earlier responses to my post (about working on Romney's campaign), so I'll post them here where I know EC will see them.

    I was a paid Romney staffer in Central Florida. In fact, I worked with his camp since April of 2011 during primary season up until Election Day. I'm a moderate Republican- nothing like the folks on FR- and took a position with the candidate "with views closest to my own." When you looked at the field in early 2011- Bachmann, Santorum, Gingrich, Cain, Perry- it was pretty obvious that Romney was the one. Besides, I had already met him a few times and he was a genuinely nice guy.

    The reason we lost was pretty simple (and overlooked entirely by the media): our staffing was terrible. With a good message, you can still win with good staffing (see Rick Scott, Florida Governor). Most of the people who worked in Florida, Ohio and Pennsylvania were first timers. Our state Hispanic Affairs Director had previously worked at a hair salon! I was the only one in Florida who had deep campaigning skills going back to about 1992. Second longest resume (in Florida anyway) went back to 2008. Pretty bad.

    1. P.S.: That "47%" video could have been fixed had Romney not essentially doubled down on his statements. Here's a video of my early work after the primary (when I actually had the ear of Gov.     3. I've seen that video many times since it first circulated. If Romney had perhaps stopped at "47% pay no income taxes," i.e., those aren't his core constituency, he might have got away with it. However, he couldn't resist adding insult to poverty, saying that those people will never take responsibility for their lives, blah blah blah, as if people enjoy poverty. As someone recently said, fark him with a chainsaw. These guys never take responsibility for their secret feelings when they blurt them out.

      Seems to me you guys did what you could. There were a few missed things that are incredibly easy to see in 20:20 hind sight.

      Look - I were a Perry guy, then Newt, Both solid and respectable track records, but they blew out. Newt because that seems to be what he does - Perry I'll cut some slack for the back surgery just before the debates. Doped or in pain is not really good for public speaking.

      But Romney is a decent man. More than decent in a lot of ways - would you shut down several profitable businesses for days to find one missing kid? He did.

      Kind of amazing.

      The 47% remark was unfortunate, though reasonably accurate. Not going to fault him for that.

    5. Lee Atwater - You start out in 1954 by saying, "Nigger, nigger, nigger." By 1968 you can't say "nigger" — that hurts you. Backfires. So you say stuff like forced busing, states' rights and all that stuff. You're getting so abstract now [that] you're talking about cutting taxes, and all these things you're talking about are totally economic things and a byproduct of them is [that] blacks get hurt worse than whites. And subconsciously maybe that is part of it. I'm not saying that. But I'm saying that if it is getting that abstract, and that coded, that we are doing away with the racial problem one way or the other. You follow me — because obviously sitting around saying, "We want to cut this," is much more abstract than even the busing thing, and a hell of a lot more abstract than "Nigger, nigger."



      And today we have the 47%.

    6. Well the interesting part about the postmortem was the media's attention to the Hispanic vote. Relatively, it doesn't matter except in Florida...and it didn't matter here. Look, the large contingent of Hispanic voters are in areas that are pretty well already decided! California, Texas, New York...and then Florida. Our camp thought Florida was ground zero. Millions in resources were earmarked here and it ultimately came down to Ohio! So in essence it didn't matter who our Hispanic Affairs Director was...even if we won Florida, it wouldn't have mattered.

      Romney's circle thought it was more important to show how similar he was to Tea Parties, assuming they'd vote our side. They just chose not to show up! These Freepers are a great example of the rank-and-file among their Tea Party brethren. They're absolutely impossible to motivate into anything other than sign waving...which is virtually useless in presidential campaigns.

      Interesting idea. The Obama campaign managed to motivate numbers of what is considered to be the most unmotivated voter base in any election - 23 to 26 year olds. Hell - that observation goes back to the 70's - the Freak Brothers had an entire comic plus a few one page bits on the importance of registering and voting!

      So what could have been done differently? Is anyone actually learning lessons here?

      @Anon 9:27 - define base. It's a big country. Chris Christie is popular with the base in New Jersey. He'd lose a vote for dog catcher in Texas.

I'd say Obama had the power of the incumbent, but a lot of his supporters in 2008 were frustrated with his performance by 2012 and didn't go above and beyond to support the campaign like they had in the previous election. I remember Obama winning Indiana because there was strong support in NWI (especially in the urban areas, which includes the infamous city of Gary), but didn't have that in 2012.
